Called to Order:  7:37 PM under the M.G.L. chapter 131, s.40 and the Hanson By-Law 1-13 s.5.

7:37 PM  RDA (Request for Determination of Applicability)
After the Fact for Old Rd. Reconstruction
                of Driveway  Assessors Map 39 Lot 32A

Mr. Dave McCormack, Sr. attended and provided colored plans as requested.  Mr. Gelsi noted that the plans were not stamped.  Ms. Cassady said she had inspected after the fact and that the road looked well done. There should have been hay bales, but the ditch is routinely maintained.  However, she was concerned that the wetland line on the map had expired.  Ms. Cassady at this point mentioned the green cards.  Mr. McCormack said that he would go home and get them.  A recess was called in reference to this particular hearing.  Mr. McCormack left at 7:47 PM

Discussion: A discussion ensued concerning Mr. Gaffey’s conservation land off of County Road (Map 83, Lot 3B).  Mr. Lindquist mentioned that there is property (Map 83, Lot 4-1)abutting the land and is owned by the Town of Hanson.  It was agreed upon to request the Selectman to transfer control of the lot shown on Map 92, Lot 23 to the control of the Conservation Commission for access to the conservation land from West Washington St..

8:00 PM   NOI (Notice of Intent) For Elm St.  Proposed
Construction of Single Family Home
Assessors Map 27 Lot 1-6

Ms. Deborah Keller from McKenzie Engineering Group, Inc. 196 Central St., Saugus, MA representing New England Architectural Builders and Remodelers, 124 Main St., Carver, MA attended the meeting.  Ms. Keller said that the lot was 1.3 acres, a single family, 4-bedroom home with a driveway is proposed and that it is well outside the 50-foot buffer zone required.  The wetlands have been flagged.  Ms. Cassady and Mr. Grattan said they had been out there and were confused about the stakes.  Ms. Keller said that the perc tests have been submitted to the BOH. Mr. Gelsi, Chairman recommended that the agent make another site visit with Mr. Grattan after it is properly staked out as to the house and septic system.  Mr. Grattan also asked that the four lot corners be staked. A Site visit will be scheduled.
        
Mr. Lindquist made a motion to continue the NOI hearing to Tuesday, June 10th at 8:00 PM.

Mr. Grattan seconded the motion.

All were in favor 4-0-0


8:10 PM  The recess ended for the RDA for Old Road and was reopened for discussion.  Mr. McCormack presented copies of the green cards and indicated that he had already brought in the originals.  Mr. Lindquist said that the submittal of the plan was incomplete.  Mr. Grattan said that an engineer stamp was needed.  Ms. Cassady mentioned to Mr. McCormack that the plan was outdated and the wetland line had expired. Mrs. McKeen made a copy of the regulations for Mr. McCormack.  

Mr. Lindquist made a motion to continue this hearing until June 24, 2003 at 7:30 PM.

Mrs. McKeen seconded the motion

8:30 PM   An Informal Meeting was held with Paul A. Fellini of Merrill Associates, Inc., 427 Columbia Rd., Hanover, MA  regarding the design of a septic system on Ocean Ave.in Hanson.     The plans call for the design of a system adequate for a two bedroom house. It was agreed that Mr. Fellini would have to file for an NOI.  Mr. Fellini said he would stop in and get a copy of the by-law and Ms. Cassady could go over with him the steps for filing.


Agents Report

Re: Bonney Hill Ln. – Ms. Cassady will watch regarding the swales on lot 2.  Mr. Grattan mentioned that he wants Ms. Cassady to find out about trails on wetlands.

Re: 310 Indian Head St. - Ms. Cassady said it’s out of the buffer zone.

Re:  7 Wagon Trail – Ms. Cassady had issue with swales.  Mr. Gelsi wants hay bales by the road.  Ms. Cassady will check.

Re:  Andrew Lane – Mr. Gelsi asked about hay bales, wants them out of the wetlands.  Mr. Gelsi wants a letter sent.


Ratification of Enforcement Orders for 1139 Main St.

Ms. Cassady initially went out and took pictures on May 8, 2003.  There were piles of fill at the edge of the wetlands.  Ms. Cassady, Mr. Grattan and Mrs. McKeen went out again on May 15, 2003 after the meeting with Mr. Bob Nickerson.  He had pushed
more fill around at that point after meeting with the Board of Commissioners who ordered him to cease cleaning up the area.   Mr. Gelsi wants to institute a fine and wants to know if we are within our legal rights to do so.  Mr. Grattan mentioned that we need the owner to come in, however, we need an address for the owner as Mr. Nickerson is leasing the property.

Special Order of Conditions signed for Lakeside Road DEP File #175-395

1.  No more than the 1,200 linear-feet proposed shall be paved. Any additional paving will require the filing of a new Notice of Intent with a variance request within the 50-foot buffer of wetland.

2.  Hay bales and a siltation fence shall be installed prior to any work.

3.  Hay bales and siltation fence shall not be removed until all storm water structures are functional.
4.  Once hay bales and a siltation fence are installed, the contractor shall notify the Commission so that an inspection can be scheduled.

5.  The Storm Water Management System Operation and Maintenance Plan shall be adhered to in perpetuity.

6.  No other work shall take place in the 50-foot buffer zone other than that on the approved plans dated January 3, 2003.
